These Website Terms & Conditions (“Terms & Conditions”) are part of, and are supplemented by, our Privacy Policy and any other operating rules, policies, price schedules, and supplemental terms or documents that we may publish from time to time (collectively, the “Agreement”).
By accessing the Site, using its content or services, contacting us, or otherwise interacting with the Site and the offerings displayed, you (each “Visitor”) agree to obey and be bound by this Agreement when you:
a) access the Site;
b) view or interact with any links to resources or information pertaining to third-party home-repair or restoration services (“Third-Party Offerings”); and/or
c) use any of the contact forms, phone numbers or other contact information on the Site to request contact from us or from third-party service providers through our referral service (the “Referral Service”).
You should review this Agreement carefully. If you do not agree with any part of this Agreement, please do not use the Site or any of The Restoration Heroes’ offerings.
This Agreement includes important legal provisions, including disclaimers of warranties, limitations of liability, release of claims, waiver of class-action rights, and mandatory arbitration of disputes. These apply to The Restoration Heroes, Ring Local LLC, and their affiliates, subsidiaries, partners, service providers and vendors (collectively, the “Covered Parties”).
Please note: The Restoration Heroes does not itself provide any of the third-party home-repair or restoration services (Third-Party Offerings) referenced. The specific terms of those offerings are set by the independent third-party providers. You acknowledge and agree that The Restoration Heroes is not liable for any loss, damage or injury that may result from your reliance on or use of the Site, the Content, or any Third-Party Offerings.
Your use of the Site and any third-party services is at your own risk.
This Agreement is the entire and exclusive agreement between you and The Restoration Heroes regarding your use of the Site and related services. It supersedes any prior or contemporaneous oral or written communications, representations or warranties.
We reserve the right, at any time and in our discretion, to change, modify, add, or remove portions of the Agreement without notice. Any changes to the dispute-resolution provisions or arbitration clauses will not apply to disputes arising before the change. The most current version will be posted on the Site and your continued use constitutes acceptance.
The Restoration Heroes does not endorse or guarantee any particular third-party service provider accessible via the Referral Service. Providers pay to be included in the Referral Service. We do not review licenses, credentials or trade-association memberships of these providers and make no representations about their suitability or performance. You are solely responsible for evaluating any provider you choose to hire.
The offerings of The Restoration Heroes are available only to individuals who: (a) are 18 years of age (or older if the majority age in your jurisdiction is more than 18); and (b) are capable of entering into legally binding contracts under applicable law. If you do not meet these criteria, you must not use or access the Site or our referral services. We may terminate or suspend access at any time in our discretion.
Please understand that The Restoration Heroes does not provide any third-party restoration services directly. We facilitate introductions or referrals. We do not control performance, quality, safety, legality or completeness of the services performed by third-party providers. We assume no responsibility for your relationship with any provider.
We may enable you to view, download or otherwise interact with materials (“Content”) on the Site. While we strive for accuracy, we cannot guarantee completeness, timeliness or suitability of the Content. You acknowledge that The Restoration Heroes is not obligated to update or correct the Content.
You are granted a limited license to access and use the Site’s offerings for personal, non-commercial use in strict accordance with this Agreement. This license is non-exclusive, non-transferable and revocable. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any portion of the Site unless authorized in writing by The Restoration Heroes.
All rights, title and interest in and to the Site, its structure, graphics, design, compilation, software, services, and other materials are owned or licensed by The Restoration Heroes and Ring Local LLC. These materials are protected by copyright, trademark and other proprietary rights. Without the express written consent of The Restoration Heroes, you may not copy, reproduce, redistribute, publish, or create derivative works from the Site content.
We reserve the right to edit, amend, delete, or remove any materials from the Site at any time in our discretion, with or without notice.
Any attempt to interfere with the operation of the Site, vandalize, tamper with or destroy any portion of the Site or its services may violate criminal and civil laws. The Restoration Heroes will pursue all available legal remedies to the fullest extent.
You agree to indemnify, defend, and hold harmless The Restoration Heroes, Ring Local LLC, their affiliates, parent and subsidiary companies, and their respective officers, directors, employees, agents, licensors, suppliers and partners from and against any and all claims, damages, losses, costs or expenses (including legal fees) arising out of or relating to:
your use or misuse of the Site or referral services;
your breach of this Agreement;
your dealings with any third-party service provider accessed through the Site;
your violation of any rights of another person.
THE SITE AND ALL OFFERINGS MADE AVAILABLE BY THE RESTORATION HEROES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE RESTORATION HEROES DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING BY COURSE OF LAW OR USAGE.
WE DO NOT WARRANT THAT THE SITE WILL MEET YOUR NEEDS, BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT YOU WILL BE ABLE TO OBTAIN ANY THIRD-PARTY SERVICES OR RESULTS THROUGH THE SITE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER THE RESTORATION HEROES NOR RING LOCAL LLC NOR THEIR RESPECTIVE AFFILIATES, PARTNERS OR SERVICE PROVIDERS SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE OR ANY SERVICES.
IN JURISDICTIONS WHERE LIABILITY LIMITATIONS ARE NOT PERMITTED, LIABILITY shall be limited to the maximum extent permitted by applicable law.
The Site may include links to third-party websites that are not owned or controlled by The Restoration Heroes. We do not assume responsibility for the availability, accuracy, content, or privacy practices of such external sites or resources. You use any such external site at your own risk.
This Agreement shall be governed by the laws of the State of New York, without regard to conflict-of-laws principles.
Any disputes between you and The Restoration Heroes or any Covered Party relating to the Site or this Agreement shall be resolved exclusively through binding arbitration administered by JAMS according to its rules. You and the Covered Parties waive any right to participate in a class action.
You may be able to opt out of arbitration by providing notice in writing within 30 days of your first use of the Site.
If any part of this Agreement is found invalid or unenforceable under applicable law, that part shall be construed to reflect the parties’ original intent, and all remaining sections shall remain in full force and effect. Our failure to enforce any right or provision does not waive our right thereafter to enforce it. This Agreement does not create any agency, partnership, or joint venture between you and The Restoration Heroes or Ring Local LLC. You may not assign your rights or obligations under this Agreement. We may assign our rights at any time without notice.
